Viscor, Inc. (“Viscor”), a subsidiary of Leviton Manufacturing Co., Inc. (“Leviton”) is committed to protecting your privacy. This Privacy Statement sets forth our current privacy practices with regard to the information we collect when you or your computer interact with our website (https://viscor.com/) (“the Website”), including any data you may provide through the Website when you sign up for our mailing lists, contact Viscor, download white papers, or purchase a product or service, or use related Viscor or Leviton apps. By accessing our Website, you acknowledge and fully understand the Privacy Policy and freely consent to the information collection and use practices described in this Privacy Policy.

It is important that you read this Privacy Policy together with any other privacy policy or notice we may provide, including on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This Privacy Policy supplements other notices and privacy policies and is not intended to override them.

A. What We Collect

Personal Information means any information about an individual from which that person can be identified or is potentially identifiable. Viscor may collect Personal Information, including names, signatures, location data, email and social media information, contact information, biometrics, financial information, IP addresses and internet browsing activity, as needed to provide products and services, including, but not limited to website functions.

When you use or connect to our Website through your computer or a mobile device, Viscor collects certain information from and about its users in a few ways: directly from our web server logs, from the User, with the aid of cookies, pixels, trackers, web beacons, and through the use of website analytics through a third-party service provider. The type of information that

gets collected depends on the section of our site that the user accesses. A large portion of our Website can be accessed by the general public without a need to share any kind of Personal Information. In those areas of the site, the information collected may include IP (Internet Protocol) address, domain name, session length, and other similar information. Viscor may use this type of information, which does not reveal the user identity, in whatever fashion it deems necessary.

Viscor or its affiliates may automatically collect technical data about your equipment, browsing actions and patterns. Other information that may be collected depends on the section of our Website that the user accesses, but may include identity data, contact information, financial or transaction data, product preferences, usage data, and communication preferences.

Visitors to our Website can register to create an account, access the Website, and download software or informational materials. When you register for an account or download materials, we will request some personal information such as your name, address, e-mail, telephone number or fax number, location, and other relevant information. Viscor will not resell or share this information with any outside entity unless it is required in order for us to comply with a law, or a court order, or to protect our vital business interests.

When you purchase products from the Website, your complete purchase order is processed by Viscor, but your payment information is submitted directly by you to a third-party website for processing of your payment only. Viscor does not collect, store, or see your financial or credit card information.

Viscor is committed to protecting your personal information from unauthorized access by having various administrative and technical safeguards in place. Any page run by Viscor that asks you for sensitive information is highly secure.

Any other communication you transmit through the Website, such as questions, comments, suggestions, or the like, may not be encrypted or otherwise secured or treated confidentially. Furthermore, by sending such transmissions, you grant Viscor a license to use such information, including Personal Information, for any purpose.

We may share or receive Personal Information about you from various third-parties and public sources, including, but not limited to the following, for the purposes discussed below:

• Analytics providers (such as Google, based outside Canada) – Names, contact information, location, preferences for the purpose of improving our website and user experience and business analytics.

Viscor does not track its customers over time and across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals, unless required to respond to DNT signals by applicable law.

If you fail to provide Personal Information where we need to collect such information by applicable law, or under the terms of a contract we have with you, and you fail to provide that information when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at that time.

B. How We Use It

Viscor may use or disclose the Personal Information collected for one or more of the business purposes listed below, subject to your right to opt out of such collection. If we disclose Personal Information for a business purpose, we require the recipient to both keep that Personal Information confidential and not use it for any purpose other than the specified by Viscor. If a third-party purchaser of your Personal Information wants to resell it, the purchaser is required by applicable law to provide you with explicit notice and an opportunity to opt out of further sales. The business purposes for collection or disclosure of Personal Information are as follows:

• To fulfill the reason you provided the information, to provide you with support, and to respond to your inquiries;

• To develop our Website and products/services;

• To maintain the safety, security, and integrity of our Website, products and services.

• To create, maintain, customize, and secure your account;

• To process your requests or purchases;

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you with notice. Additionally, we will not keep Personal Information any longer than required by applicable law or needed to complete the purpose for which we collected it.

4. COOKIE STATEMENT

Set forth below are our current practices with regard to the information we collect via cookies, pixels, and web beacons (collectively “Cookies”) when you or your computer interact with our Website.

A. What Are Cookies?

E. WebServer Logs and Web Beacons

i. Web Server Logs

When you visit our Website, we may track information through web server logs to better administer the site and analyze its usage. Examples of information we may track include but is not limited to your Internet Protocol address, the type of browser or computer you use, the number of links you click within the Website, the geographical location from which you accessed it, the date and time of your visit, the name of your Internet service provider, any web pages you linked to our Website from, and pages you viewed on the Website.

ii. Use of Web Beacons or GIF Files

This Website may contain electronic images known as “Web Beacons” (also called single-pixel gifs) that allow Viscor to count users who have visited those pages and to deliver co-branded services. Viscor may include Web Beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon. Viscor prohibits Web Beacons from being used to collect or access your Personal Information.

5. NOTICE ON DISCLOSURE OF USER PERSONAL INFORMATION

We may share your Personal Information with third-parties, including internal third-parties (other Viscor affiliated or related entities), external third-parties (such as vendors and service providers, including, but not limited to cybersecurity companies, analytics companies, market researchers), and third-parties to whom we may choose to acquire, sell, transfer or merge parts of our business or our assets. If a change happens to our business, then the new owners may use your Personal Information in the same way as set out in this Privacy Policy. We do not sell your Personal Information to any third-parties.

We will only disclose your Personal Information to the aforementioned third-parties (i) to fulfill your service requests; (ii) if such disclosure is required by applicable law, regulation, legal process, or law enforcement or government regulatory authorities, in which case we shall give you as much advance notice as is reasonably practicable in order to allow you to limit or restrict such disclosure; or (iii) is required to be disclosed in order for us to protect our legal rights or defend against liability; or (iv) in connection with a company reorganization, merger, acquisition, or sale.

We require all third parties to respect the security of your Personal Information and to treat it in accordance with applicable law. We do not allow our third party service providers to use your Personal Information for their own purposes and only permit them to process your Personal Information for specified purposes and in accordance with our instructions. Recipient third parties will be required to agree to a duty of confidentiality and are obliged to implement appropriate technical and organizational measures to ensure the security of Personal Information.

6. INTERNET BASED DATA TRANSFERS

Given that the Internet is a global environment, using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis. Therefore, by browsing this Website and communicating electronically with us, you acknowledge and agree to our processing of Personal Information in this manner.

We share your personal data within Viscor’s related and affiliated entities, including, but not limited to Leviton Manufacturing Co., Inc., located in USA. Such transfers are facilitated by means of intra-company agreements, which apply contractual protections and other safeguards, as required by applicable privacy laws. In addition, we may also share your information with service providers, such as IT software support, cloud service providers, or a company running marketing campaigns on our behalf. This may involve transferring your data outside Quebec. Whenever we transfer your personal data out of Ontario, we ensure an equivalent degree of protection is afforded to it by ensuring that appropriate safeguards are implemented. We will only transfer data to locations deemed to have adequate levels of protection for personal data), or where this is not the case, we will put in place contractual clauses to protect your personal data.

7. UNDER THE AGE OF 13 POLICY

We do not knowingly collect Personal Information from children under 13. If we learn that we have collected the Personal Information of a child under 13 without first receiving verifiable parental consent, we will take steps to delete the Personal Information as soon as possible.

8. DATA SECURITY

We have put in place appropriate security measures to prevent your Personal Information from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions, and they are subject to a duty of confidentiality as well as other obligations as required by applicable law.

We have put in place procedures to deal with any suspected Personal Information breach and will notify you and any applicable regulator or government agency, including of a breach where we are legally required to do so.

9. DATA RETENTION

We will only retain your Personal Information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. 10. YOUR LEGAL RIGHTS

A. Your Rights

You have the right to request from Viscor information about your Personal Information processed, erasure of your Personal Information, and restriction of the processing of your Personal Information (such as direct marketing).

Specifically, you have the right to request:

  •  Access and disclosure of Personal Information that Viscor has collected about you;
  •  Disclosure of the categories of third parties with whom Viscor sells or shares the Personal Information;
  •  To stop or limit the use of Sensitive Personal Information;
  •  To object to automated decision making or to be provided more information about the process and decisions, including but not limited to targeted advertisements.
  •  To opt-out of international transfers of your data, subject to certain exceptions.
  •  Deletion or correction of the Personal Information collected, subject to certain exceptions. Once we receive and confirm your request, we will delete or correct (and direct our service providers or contractors to delete, if applicable) your Personal Information from our records, unless an exception applies. An exception to your request may apply if retaining the information is necessary for us or our service provider(s) to do the following: 
    • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract or requested action with you;
    •  Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
    •  Debug products to identify and repair errors;
    •  Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
    •  Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with Viscor;
    •  Comply with a legal subpoena or court order;
    •  Make other internal and lawful uses of that information that are compatible with the context in which you provided it; and/or,
    •  To provide technical support or troubleshooting related to your account or a Viscor product or service.
  •  To opt out of the share or sale of Personal Information
    •  If you are 16 years of age or older, you may direct us to not sell your Personal Information at any time.
    •  Once you make an opt-out request, we will wait at least 12 months before asking you to reauthorize Personal Information disclosure or sales. However, you may change your mind and opt back in to Personal Information disclosures or sales at any time by supplying your Personal Information to Viscor on its Website or by contacting Viscor via the methods set out in the “Contact Us” Section (Sec. 12) of this policy. You do not need to create an account with us to exercise your opt-out rights. We will only use the Personal Information provided in an opt-out request to review and comply with the request.

B. Exercising Your Rights (Opt-outs)

You can ask us or third-parties to stop sending you marketing messages at any time by submitting an opt-out request via the form on our Website, by contacting us at __ marketing@viscor.com or by following the opt-out links on any marketing message sent to you. Where you opt out of receiving these marketing messages, this will not apply to Personal Information provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

To exercise your data protection rights (a list of your rights are provided in Section 10 of this Privacy Policy) such as the right to request from Viscor information about your Personal Information processed, erasure of your Personal Information, and restriction of the processing of your Personal Information, please contact us via the methods set out in the “Contact Us” Section (Sec. 12) of this policy.

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights) in most circumstances. However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could limit or refuse to comply with your request in these circumstances.

C. Responding to Your Request

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Once we receive and confirm your request, we will respond within 30 days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. Unless otherwise required, any disclosures we provide will only cover the 12-month period preceding the date of the receipt of the request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily usable and should allow you to transfer the information from one entity to another without difficulty.

D. Who may make a request?

Only you, or a designated agent that you authorize to act on your behalf (with proof of authorization), may make a request related to your Personal Information. You may also make a request on behalf of your minor child. You may only make a request for access or data portability twice within a 12-month period. The request must: (i) provide sufficient information that allows us to reasonably verify that you, or the person on whose behalf you are requesting, are the person about whom we collected Personal Information; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a request does not require you to create an account with us. We will only use Personal Information provided in a request to verify your identity.

11. CHANGES TO THIS STATEMENT

Viscor may periodically update this Privacy Policy. When we do, we will also revise the “updated” date appearing on the first page of this Privacy Policy. We encourage you to periodically review this Privacy Policy to stay informed about how we are helping to protect

the Personal Information we collect. Your continued use of the service constitutes your agreement to this Privacy Policy and any updates.
